Client Contract

The photographer and client agree to the following terms and conditions:

*The client agrees to pay a session fee in the amount of $200 (maternity, newborn, sitter, cake smash, family) to serve as a retainer that will reserve the above listed date and time.

*A product purchase minimum of $750 is required separate from the session fee.

*Outdoor sessions are performed at approved location. If there is a permit fee or cost of admission, it is the responsibility of the client to cover this cost as well as any admission for the photographer.

*Photographer will provide a gallery of minimum 35 color images plus black and white conversions for a minimum total of 70 images. If additional images are included in the gallery, they are considered to be a bonus to the client. Photographer retains the right to photograph and edit the photographs in her own artistic style and will omit any image that does not meet her approval.

*Client will pay invoice upon receipt for their product/digital purchase.

*All images are property of the photographer but all rights are also given to whomever purchases digitals/products.

*Clients and all in attendance of scheduled photo session are PROHIBITED from use of personal cameras and cell phone cameras to take their own photos of baby/children on set during the session.

*If the Photographer cannot perform this Contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness or emergency, then the Photographer shall reschedule the portrait session.

*This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer.

*Client understands that by entering into this agreement, Photographer is foregoing other photographic jobs. In the event of a cancellation or postponement of the portrait session/agreement by Client, the deposits paid are non-refundable. Deposits are transferable if a date change is necessary. 24 hours notice of postponements or cancellations is required.

*RESHOOTS: In the unlikely event that Client is completely dissatisfied with the final results based solely on personal preference, Photographer will reshoot at a 25% discount from the original session fee. Client is then able to order prints from the second portrait session only.

*The charges in this Contract are based on the Photographer’s Standard Price List. This price list is adjusted periodically. In the event of a price change, Lara K Photography will grant the price from the price list used at time of purchase for 30 days from the date of the session. Any purchases after 30 days from that price list will purchase at the pricing in effect.

*Photographer takes the utmost care with respect to the exposure, retouching, and transportation of digital captures, proofs and prints. However, in the unlikely event that all the originals are lost, stolen, damaged or destroyed within or beyond Photographer’s control, Photographer’s liability is limited to the refund of all payments received, or a reshoot can be scheduled at no additional cost. The limit of liability for partial loss or damage of originals shall be a prorated amount of the total amount, based on the percentage of originals lost or damaged. In the unlikely event that Photographer is injured or becomes too ill to attend the portrait session, Photographer will make every effort to reschedule to the earliest possible date. If the situation should occur, responsibility and liability is limited to the return of all payments received.

*Keep in mind that all monitors vary in color and brightness when viewing your online gallery. Lara K regularly calibrates her monitor to match that of her professional printing lab. Due to the custom nature of each order, ALL SALES ARE FINAL. Lara K is not responsible for printing results from outside labs not associated with her business when digital files are purchased by the client.

*NOTICE OF COPYRIGHT: All images are copyrighted to and remain the property of Lara K Photography. It is ILLEGAL to copy or reproduce these photographs elsewhere without Photographer’s written permission, and violators of this Federal Law will be subject to its civil and criminal penalties.

*This agreement contains the entire understanding between Photographer and Client. It supersedes all prior agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties want to waive one provision of this agreement, it does not mean that any other provision is also waived. This constitutes an order for one portrait session with Lara K Photography. This client agreement must be submitted to the photographer in order for session to take place.
